Dual Occupancy

Dual occupancy defines “two dwellings on one title, either attached or detached.”

Maximise the potential of your block of land by building a dual occupancy dwelling on your lot. It is a smart decision for the investors to increase their property portfolio with improved cash flow. Dual occupancy will provide you with twice the rental income. As potentially high-income property investments, they represent a vehicle for improved cash flow.

Secondary Dwelling

The Standard Instrument LEP Order defines a secondary dwelling as a self-contained dwelling that:

  1. is established in conjunction with another dwelling (the principal dwelling)
  2. is on the same lot of land (not being an individual lot in a strata plan or community title scheme) as the principal dwelling
  3. is located within, or is attached to, or is separate from, the principal dwelling

Generally, the maximum floor area permitted for the secondary dwelling is 60m2. It is important to note that the rules are determined by factors such as the size of the residential block and the size of the existing house. Variations to these rules may be permitted by the local council subject to a development application being submitted.

A secondary dwelling can also be approved using complying development provided it complies with the requirements set out in the Affordable Rental Housing SEPP including clause 23.

Building Approvals

Our team at Achiy Homes will ensure the right approvals are sought, and that applications include all the required details to assist with a smooth progression through the process.

There are two distinct pathways for getting your build approved. Depending on the size and complexity of your new custom home, and the council catchment you’re building in, we will apply for either a Complying Development Certificate (CDC), or a Development Application (DA).

Development Application (DA)
A DA is lodged with the local council for consent to proceed with your development. This is a six-stage process, with rules, regulations and requirements that usually vary by council area. Approval can take four to eight weeks. The NSW Government has this handy online guide.
Our end goal is the same as yours – to receive a construction certificate as quickly as possible, to start turning your plans into an exciting reality.

Complying Development Certificate (CDC)
CDC is a fast-track approval process for straight forward developments that meet pre-determined standards. It’s code-based, with standard rules and regulations across NSW. The CDC process can even be finalised within two weeks of lodgment.
When you’re keen to get started, a CDC may seem like the obvious pathway to take, but the alternative may be better suited to builds that are larger, more adventurous or complex.
